Welcome to EVOQUE. These Terms of Service (“Terms”) govern your access to and use of the website evoque.life (the “Site”) and the purchase of any products from us. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site. In these Terms, “we”, “us”, “our” and “EVOQUE” refer to Evoque Limitless Pty Ltd (ABN 22 608 901 122), the operator of this store, and “you” refers to the customer or Site visitor.

1. Eligibility

You must be at least 18 years old to purchase from EVOQUE. By placing an order you confirm that you are 18 or over and that the information you provide is accurate and complete.

2. Our products — important health information

EVOQUE sells dietary and nutritional supplements, including exogenous ketone products. Please read the following carefully:

  • Our products are foods/dietary supplements. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition.

  • The information on our Site is provided for general information only and is not medical advice. It is not a substitute for advice from a qualified healthcare professional.

  • You should consult your doctor or a qualified healthcare professional before using our products, particularly if you are pregnant, breastfeeding, under medical supervision, taking medication, following a ketogenic or other restricted diet, or have any pre-existing health condition.

  • Always read the label and directions before use, and use only as directed. Do not exceed the recommended dose.

  • Our products may contain or be produced in facilities that handle allergens. Please review the ingredient list before use if you have allergies or intolerances.

  • Discontinue use and seek medical advice if you experience any adverse reaction.

To the extent permitted by law, EVOQUE is not liable for any consequences arising from the misuse of our products or from use contrary to the label directions or professional advice.

3. Product information, pricing and availability

We take care to describe our products accurately, but we do not warrant that product descriptions, images, ingredient information or other content are error-free. Colours and packaging may vary. All prices are listed in Australian Dollars (AUD) and, where applicable, are inclusive of GST. Prices and product availability may change without notice. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information at any time without prior notice.

4. Orders and acceptance

Your order is an offer to purchase. All orders are subject to acceptance and product availability. We may, at our discretion, refuse or cancel an order for any reason, including where a product is out of stock, where there is an error in pricing or product information, or where we suspect fraudulent activity. If we cancel an order that you have already paid for, we will refund the amount paid.

5. Payment

Payment must be made in full at the time of ordering through the payment methods offered at checkout. By providing payment details you confirm that you are authorised to use the payment method. All payments are processed securely by our third-party payment providers; EVOQUE does not store your full card details.

6. Shipping and delivery

Delivery timeframes are estimates only and are not guaranteed. Risk in the products passes to you on delivery. Please refer to our Shipping Policy for details of delivery methods, timeframes and costs. We currently deliver within Australia only.

7. Returns and refunds

Returns and refunds are handled in accordance with our Refund Policy, which forms part of these Terms and does not limit your rights under the Australian Consumer Law.

8. Intellectual property

All content on the Site, including the EVOQUE name, logos, text, graphics, images, product designs and layout, is owned by or licensed to EVOQUE and is protected by intellectual property laws. You may not copy, reproduce, distribute or use any content for commercial purposes without our prior written consent.

9. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to introduce malicious code, or to attempt to gain unauthorised access to any part of the Site or its systems.

10. Reviews and submissions

If you submit a review, comment or other content, you grant EVOQUE a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our business. You are responsible for the content you submit and must not post anything unlawful, misleading, defamatory or that infringes another person’s rights.

11. Consumer guarantees and warranties

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Except for those guarantees and any other rights you have under law, and to the maximum extent permitted by law, the Site and products are provided “as is” and we exclude all other warranties, express or implied.

12. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot be excluded. Subject to that, and to the maximum extent permitted by law, EVOQUE’s total liability arising out of or in connection with the Site or any product is limited, at our option, to the replacement of the goods or the resupply of, or payment of the cost of resupplying, the goods. To the extent permitted by law, we are not liable for any indirect, incidental or consequential loss.

13. Indemnity

To the extent permitted by law, you agree to indemnify EVOQUE against any claims, losses or costs arising from your breach of these Terms or your misuse of the Site or products.

14. Privacy

Your personal information is handled in accordance with our Privacy Policy and applicable Australian privacy laws.

15. Changes to these Terms

We may update these Terms from time to time. The version in effect at the time you place an order applies to that order. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

16. Governing law

These Terms are governed by the laws of Queensland, Australia. Any dispute will be subject to the non-exclusive jurisdiction of the courts of Queensland and the federal courts of Australia. Nothing in this clause limits your rights under the Australian Consumer Law.
