Affiliate Program Terms

These terms are an agreement between Evoque Limitless Pty Ltd (ABN 22 608 901 122) ("Evoque", "we", "us") and you, the affiliate. By accepting an invitation to, or joining, the Evoque Affiliate Program through Shopify Collabs, you accept these terms.

1. Joining

You must be 18 or over and live in Australia. The program is by invitation or approved application. We may decline any application without giving a reason.

2. Your link and code

We give you a personal link and discount code through Shopify Collabs. Share them only as these terms allow. Don't change them, or pass them to anyone else to use as their own.

3. Commission

  • You earn your tier's commission rate on eligible orders. Eligible orders are those attributed to you by Shopify Collabs (through your link or code) and placed by a customer who isn't you or a member of your household.
  • Commission is calculated by Shopify Collabs on the eligible order value shown in your Collabs account.
  • For subscription orders, commission applies to the first order only.
  • Attribution is as tracked by Shopify Collabs. We can't pay commission on orders Collabs doesn't attribute to you.

4. Tiers

Tiers, rates and how to qualify are set out on our program page at evoque.life/pages/affiliates. We review tiers monthly. We may change rates or tiers with 14 days' notice by email. Changes don't affect commission you've already earned.

5. Holding period and payment

  • Commission on each order is held for 45 days, then approved. This covers delivery and our 30-day returns window.
  • Commission on orders that are cancelled, refunded, returned or charged back during the hold is cancelled.
  • Approved commission is paid by Shopify Collabs, twice a month, once your payout balance reaches US$25.
  • Payouts are made in US dollars. Your bank or payout provider converts them, and conversion fees may apply.
  • You are responsible for setting up and keeping your payout details current in Shopify Collabs.

6. Tax

If you carry on a business, give us your ABN. You are responsible for your own income tax and GST, including on the value of any gifted product. If you don't provide an ABN, we may need to withhold tax unless you give us a valid Statement by a supplier (for example, because this is a hobby).

7. Disclosure

  • Every time you promote Evoque, you must clearly disclose that you earn a commission, or that you received a gift.
  • Put it at the start of captions (for example "#ad" or "Affiliate link: I earn a commission"), on every story frame, spoken in video, and in messages and emails.
  • This applies to posts about tubs we've gifted you, too.

8. What you can say

  • Follow the Evoque Brand & Claims Guide. Share only your genuine personal experience.
  • Don't make claims about weight loss, appetite, disease, medical conditions, mood or guaranteed results, or any claim that isn't in the guide.
  • Don't present our wording as your own experience unless it is true for you.

9. Prohibited promotion

You must not:

  • bid on "Evoque" or related terms in search ads
  • run paid ads without our written approval
  • post your code on coupon or deal sites
  • send messages to people you don't know personally, send bulk messages, or use bought or scraped contact lists
  • post fake reviews
  • use misleading or offensive content
  • suggest that you are Evoque or speak for it

10. Brand use

We give you a limited, revocable licence to use our name, logo and supplied assets only to promote Evoque under these terms. Don't alter our logo, or register domains or social handles containing "Evoque".

11. Your content

You own the content you create. You allow us to reshare it on our channels with credit. We'll ask before using it in paid ads.

12. Independent relationship

You are an independent affiliate, not an employee, agent or partner of Evoque.

13. Ending the agreement

  • Either of us may end this agreement with 14 days' written notice.
  • We may end it immediately if you breach these terms.
  • Commission earned on eligible orders before the end date is still paid after the hold, except where the agreement ended for fraud or a serious breach.

14. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law. Otherwise, to the extent the law allows, our total liability to you is limited to the commission we owe you. You agree to cover losses we suffer because you breached these terms or the law.

15. Privacy

We handle your personal information under our Privacy Policy. We use Shopify Collabs to run the program and Klaviyo to send program emails. Don't collect customers' personal information through your promotion of Evoque.

16. Changes and governing law

We may update these terms with 14 days' notice by email. These terms are governed by the laws of Queensland, Australia.
